Terms of Use
These terms apply to your use of the Humi website and the Humi app (together, the “Service”), provided by Humi (“Humi”, “we”, “us”). By using the Service you agree to them. If you do not agree, please do not use it.
1. Using Humi
Humi is a personal ambient sound app for relaxing, focusing and sleeping. We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on your own devices for your own non-commercial use, subject to these terms and the rules of the app store you downloaded it from.
2. What you may not do
- Copy, extract, redistribute or resell the sounds, pictures, music or other content in Humi.
- Reverse engineer, decompile or tamper with the app, except where the law allows it despite this restriction.
- Use the Service in a way that is unlawful, harmful, or that interferes with it or with other people’s use of it.
- Use the Service for public performance or in a business setting, such as playing it to customers, without our written permission.
3. Not medical advice
Humi is a relaxation and focus tool. It is not a medical device and does not diagnose, treat, cure or prevent any condition, including sleep disorders, anxiety or hearing problems. We make no promise that it will help you sleep or concentrate. If you have a health concern, speak to a qualified professional.
4. Use it safely
- Keep the volume at a comfortable level to protect your hearing, especially with headphones.
- Do not use Humi in a way that stops you hearing important sounds, for example while driving, cycling, crossing the road or operating machinery.
- Check that your phone has enough battery when you rely on it overnight. Humi can stop playback when the battery is low.
5. Content and ownership
The Humi name, logo, app, design, pictures, music and sound recordings belong to us or to our licensors and are protected by intellectual property laws. Some recordings are used under licences from third parties. Except for the limited licence in section 1, these terms give you no ownership of or right to use that content.
6. Free to use, and future paid features
Humi launches free. We may later add optional paid features. If we do, we will show the price and terms clearly before you buy, and purchases will also be subject to the app store’s terms. We will not charge you for anything without your clear consent.
7. The waitlist
Joining the waitlist only means you will receive an email when Humi is available. It does not reserve anything, and it is not a promise of a launch date or of any feature.
8. Third-party services
The Service relies on third parties, such as the Apple App Store and Google Play, your phone’s operating system, and, if you turn on weather, MET Norway. We are not responsible for their services, and their own terms apply to your use of them.
9. Privacy
Our Privacy Policy explains what Humi does and does not collect. It forms part of these terms.
10. Availability and changes
We work to keep Humi running well but cannot promise it will always be available, error-free or compatible with every device. We may change, suspend or discontinue any part of the Service at any time, and we may update these terms. When we make material changes we will update the date above and, where reasonable, tell you in the app or on this site. Continuing to use the Service after a change means you accept it.
11. Disclaimer
To the fullest extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement.
12. Limit of liability
To the fullest extent the law allows, Humi and the people behind it are not liable for any indirect, incidental, special or consequential loss, or for loss of data, profits or sleep, arising from your use of or inability to use the Service. Where liability cannot be excluded, it is limited to the amount you paid us for the Service in the 12 months before the claim, which for a free app is zero. Nothing in these terms limits any right you have under law that cannot be limited, including consumer rights.
13. Ending your use
You can stop using Humi at any time by uninstalling it. We may suspend or end your access if you break these terms. Sections that by their nature should continue to apply after that, such as content ownership, disclaimers and limits of liability, will do so.
14. Governing law
These terms are governed by the laws of the Republic of the Philippines. Any dispute will be handled by the proper courts of the Philippines, unless a mandatory consumer law of your home country says otherwise.
